1) 3 orientations have different energies, the nuclei pointing up have the lowest energy. The splitting is made by interacting with a surrounding magnetic field. It can be seen that the field must be pointed in the upper z direction
2) in low temperature, the low energy levels will be occupied. This means the upper orientation will be preferred.
